WARRANTY CONDITIONS

GENERAL TERMS AND CONDITIONS OF WARRANTY
(entered into force 2nd of May, 2013)

1. The Sales Warranty (hereinafter “the Warranty”) are items (hereinafter referred to as “products”) purchased from Inseneri Auto OÜ. The warranty is valid if the customer provides an original invoice or a cash receipt with the fixed date of the delivery of goods. Manufacturers may additionally require the submission of a completed and valid warranty certificate. The warranty is valid on the territory of the Republic of Estonia.

2. Pursuant to the Law of Obligations Act, the consumer is entitled to submit complaints to the seller within two years from the date of the transaction.
The warranty does not restrict the client’s right to use the two-year claim provided for in § 218 (2) of the LOA or other consumer rights arising from law.

3. The customer has a statutory obligation to inform the seller of a defect found on the goods within two months of their occurrence.

4. The exact length and conditions of the warranty period for all products are determined by the manufacturer. The warranty conditions are outlined in the manufacturer’s documentation and/or website.

5. The warranty will be valid for the customer from the date of delivery of the goods unless otherwise stated on the sales invoice or in a separate agreement.

6. The warranty covers the costs of repairing said defects caused to the product due to manufacturing, construction and/or material errors of the delivered goods.

7. The warranty is not applicable to used goods!

8. Warranty is not applicable to:
• Consumables – brake pads, clutch discs, filters, belts, lubricants, etc.
• Packaging and other documentation.
• Used products

9. Inseneri Auto carries out warranty repairs only for malfunctions that are not caused by incorrect use and/or wear of the product.
Free warranty repairs will not be conducted in the event of a malfunction caused by:

9.1. Mechanical wear, excessive force applied and physical defects arising from use.

9.2. Defects caused by the use of a product in a more complex environment than specified in the manufacturer’s technical documentation (for example very high amount of dust, too high or low temperatures, excessive moisture, low or excessive lubricant, radiation, contact with corrosive chemicals, etc.).

9.3. Defects arising from the use of different maintenance materials other than those authorized by the manufacturer, as well as connecting to the product to a uncertified diagnostic device.

9.4. Defects resulting from the use of unauthorized third-party accessories or components.

9.5. Defects that are the result of some natural forces (thunder, flood, earthquake, storm, etc.).

9.6. Defects resulting from violent acts, riot, war, or extraordinary situations.

9.7. Defects caused by a nuclear catastrophe or radiation.

9.8. Defects that arise from the incompatibility of software products and their incorrect use.

10. The right to free warranty repairs will become void when the products have been repaired or have been modified by a person not authorized by Inseneri Auto.

11. For free warranty repairs, the product owner is required to discontinue use of the product after a malfunction occurs. The product may not be used until after consulting an Inseneri Auto’s representative.

12. If it is discovered that the failure is due to the reasons listed in points 7 to 16, the customer loses the right to receive free warranty repairs and is required to pay all costs arising from the repairs, removing of defects and transport.

13. Inseneri Auto OÜ is not responsible for:
13.1. Failure to rectify defects in the product if the defect did not appear during warranty repair or its occurrence has not been registered at the time of the product warranty repair.

13.2. Product fatigue on used products due to product defects or breakdowns.

13.3. Maintain the software and data stored in the firmware.

If the phone call or the letter fails to resolve the problem, then the device in need of repair must be brought to Inseneri Auto OÜ Customer Service at  Mõisa rd. 17, Ääsmäe village, Saue municipality, Harju county, 76402, Estonia.

15. It is also possible to invite an Inseneri Auto specialist on the spot, in which case the invoicing will be done according to the general price list of the services of Inseneri Auto OÜ. It is possible to conclude a separate contract for the on-site warranty.

16. All other consumer rights are the originate from the Law of Obligations Act of the Republic of Estonia, the Consumer Protection Act and other legal acts.

17. Due to the obligation of the trader specified in § 19 (6) of the Tax Code, the written complaint of a consumer shall receive a response within 15 days of receipt thereof.

Definitions

Warranty – In the sense of the Law of Obligations Act, a sales warranty, pursuant to Section 230 of the Law of Obligations Act, the promise given by the seller as sales warranty for a certain period of time to offer the consumer a more favorable position than the law. In other words, the warranty may offer the consumer more rights than the rights that apply to the two-year period of claiming.

Expertise – expertise was done by Inseneri Auto OÜ or the manufacturing company on the product to assess the existence and cause of the defect.

Independent expert assessment – If you do not agree with the results of the expert analysis carried out by Insener Auto OÜ, an additional expert assessment will be carried out at the request of the client.

Right to file a complaint – The 2-year term for submission of a claim is set out in § 218 (2) of the LOA.

Consumers – According to the Law of Obligations Act, a consumer is deemed to be a natural person who has purchased from the Insener Auto Auto OÜ, goods or services that are not related to his or her economic or professional activities.

Warranty replacement – If the repair of the product proves to be impossible or its production has been concluded then, Insener Auto OÜ (with the customer’s consent) may replace the product with the equivalent.

Fault – A fault that is a permanent or recurring interference with the product. Faults do not include software failures.
